DIY Plan Terms of Service
1. Agreement
By purchasing and using an Aware Integrations DIY Plan (“Service”), you (“Client”) agree to be bound by these Terms of Service (“Terms”). Please read them carefully before completing your purchase.
2. Service Description
The DIY Plan provides access to a cloud-based CRM and marketing platform provisioned and managed by Aware Integrations (“Company”). The platform includes the features specified for your selected plan at the time of purchase. Access is provided on a subscription basis.
3. Billing & Payment
- The DIY Plan is billed at the monthly rate corresponding to the plan selected at the time of purchase, charged automatically to your payment method on file.
- Billing begins immediately upon purchase and recurs monthly on the same date.
- Plan pricing is displayed clearly on the checkout page prior to completing your purchase.
- All payments are processed securely via Stripe. By providing your payment details, you authorize Aware Integrations to charge your payment method on a recurring basis.
- All fees are non-refundable except as required by applicable law.
4. Plan Changes
- You may upgrade or downgrade your plan at any time from your account billing settings.
- Plan changes take effect at the start of the next billing period unless otherwise specified.
- Mid-cycle plan changes may result in prorated charges or credits applied to your next billing statement.
5. Cancellation
- You may cancel your subscription at any time through your account billing settings or by contacting Aware Integrations directly.
- Cancellation takes effect immediately upon confirmation. Access to the platform will be suspended at that time.
- No refunds are issued for any unused portion of the current billing period.
- Any remaining wallet credits or balances are forfeited upon cancellation.
- You may reactivate your subscription at any time by contacting Aware Integrations.
6. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Send unsolicited or spam communications
- Infringe on the intellectual property rights of others
- Engage in fraudulent, abusive, or harmful activities
Aware Integrations reserves the right to suspend or terminate access for violations of this policy without refund.
7. Platform Availability
The Company will make reasonable efforts to maintain platform availability. Scheduled maintenance, third-party outages, or events beyond our control may result in temporary interruptions. We are not liable for any losses resulting from downtime.
8. Limitation of Liability
To the maximum extent permitted by law, Aware Integrations shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount paid in the three (3) months preceding the claim.
9. Modifications
Aware Integrations reserves the right to modify these Terms at any time, including plan pricing and features. You will be notified of any material changes. Continued use of the Service following notice of changes constitutes acceptance of the updated Terms.
10. Governing Law
These Terms shall be governed by the laws of the State of North Carolina, without regard to its conflict of law provisions.
